RE: DRAFT GUIDELINES/APPLICATION FORM FOR
REQUESTED
COURT COSTS AND FEES
Enclosed is a copy of the draft guidelines and application
form prepared by the Judicial Council’s Committee to
Evaluate the Need for Requested Court Costs and Fees (hereinafter
referred to as the “Court Cost/Fee Committee”)
to guide the Judicial Council’s process of reviewing
and evaluating requests for new court costs and fees or increases
in existing court costs and fees pursuant to R.S. 13:61 (Act
202 of the 2003 Regular Legislative Session).
Under the requirements of Act 202, no law to provide for a
new court cost or fee or to increase an existing court cost
or fee shall be enacted unless first submitted to the Judicial
Council for review and recommendation to the legislature.
The Judicial Council has created the Court Cost/Fee Committee
to develop draft guidelines and an application form for the
Council’s approval, and to review and evaluate requests
submitted in accordance with the adopted guidelines and application
prior to their consideration by the Council.
Prior to the Judicial Council’s adoption and final approval
of the guidelines and application form in December, a briefing
hearing on these matters will be conducted by the Court Cost/Fee
Committee on December 10, 2003 from 10:00 am –
12:00 pm in Courtroom A of the Fifth Circuit Court of Appeal,
101 Derbigny Street, Gretna, LA 70053. Anyone interested
in the Council’s new process or wishing to ask questions
or make comments regarding the draft guidelines, application
form, deadline for submitting requests, or other aspects of
the process is invited to come and participate at the hearing.
After the hearing, the Committee will consider the public’s
comments, revise, if necessary, its draft of guidelines and
its application form, and forward its recommendations to the
Judicial Council for final approval and adoption by ballot
vote. The final guidelines and application form will be available
