MARCUS, J. -
would grant a rehearing. On further consideration, I
am of the opinion that the dissents were correct, that
is, the legislature intended to overrule the Berry
decision and return to the "integral relation"
test outlined by this court in Thibodaux. In my view,
the majority's test will produce the same result reached
under Berry , making the 1989 amendment to La.
R.S. 23:1061 meaningless.
