On the 15th day of November, 1996 , the following action was taken by the Supreme Court of Louisiana in the case(s) listed below:
 

REHEARINGS DENIED :

95-KA- 0638 STATE OF LOUISIANA v. LARRY ROY (Parish of Rapides)

95-C - 1830 ROGER KIRKLAND v. RIVERWOOD INTERNATIONAL USA, INC. (Parish of Ouachita)

CALOGERO, C.J. - also concurs in rehearing denial and assigns reasons.

MARCUS, J. - would grant a rehearing. On further consideration, I am of the opinion that the dissents were correct, that is, the legislature intended to overrule the Berry decision and return to the "integral relation" test outlined by this court in Thibodaux. In my view, the majority's test will produce the same result reached under Berry , making the 1989 amendment to La. R.S. 23:1061 meaningless.

WATSON, J. - votes to deny rehearing and joins in concurring reasons of the Chief Justice.

KIMBALL, J. - would grant a rehearing.

VICTORY, J. - would grant a rehearing.
