News Release #072

FOR IMMEDIATE NEWS RELEASE

NEWS RELEASE # 072

FROM: CLERK OF SUPREME COURT OF LOUISIANA

On the 28th day of August, 1997 , the following action was taken by the Supreme Court of Louisiana in the case(s) listed below:

STAY ORDER GRANTED IN PART; OTHERWISE DENIED:

97-KP- 2214 STATE OF LOUISIANA v. GERALD PARKER (Parish of Orleans)

STAY ORDERS DENIED; WRITS DENIED :

97-KK- 2173 STATE OF LOUISIANA v. ULYSSES JONES (Parish of Jefferson)

CALOGERO, C.J. - not on panel.

JOHNSON, J. - would grant the writ.

97-KK- 2212 STATE OF LOUISIANA v. WAYNE WINESBERRY (Parish of Jefferson)

CALOGERO, C.J. - concurs in this Court's action. As I appreciate the issue involved as to which the court of appeal and this Court have denied writs, it has to do with the trail court's ruling simply allowing the State to obtain additional chemical testing. What may develop at the time the result of that testing is offered through testimony or otherwise at trial remains to be seen--including what may develop by way of defense counsel's request for its own opportunity to have the evidence tested.

KNOLL, J. - not on panel.

On the 29th day of August, 1997 , the following action was taken by the Supreme Court of Louisiana in the case(s) listed below:

MARCUS, J. - votes to deny the application.
