The opinions handed down on the 25th day of September, 1998 , are as follows:

PER CURIAM :

97-K - 2930 STATE OF LOUISIANA v. GUADALUPE SALINAS

(Parish of Calcasieu)

(Possession of Marijuana with Intent to Distribute)

Accordingly, the defendant's term of 25 years imprisonment at hard labor is reinstated, and this case is remanded to the trial court for execution of that sentence.

SENTENCE REINSTATED; CASE REMANDED.

(Second Degree Murder)

Accordingly, we reverse the decision of the court of appeal, reinstate the jury's verdict of second degree murder and affirm the defendant's conviction for second degree murder and his sentence of life imprisonment at hard labor without benefit of parole, probation, or suspension of sentence.

JUDGMENT OF THE COURT OF APPEAL REVERSED; VERDICT REINSTATED; CONVICTION AND SENTENCE AFFIRMED.
