Accordingly,
we reverse the decision of the court of appeal, set
aside relator's conviction and sentence, and remand
this case to the district court for all further proceedings
in accord with the law.

Accordingly,
the judgment of the court of appeal is reversed. The
verdict renderd by the trial court is reinstated, and
this case is remanded to the district court for purposes
of clarifying the respondent's present status and for
all further proceedings not inconsistent with the views
expressed herein.
