News Release #010

FOR IMMEDIATE NEWS RELEASE

NEWS RELEASE # 10

FROM : CLERK OF SUPREME COURT OF LOUISIANA

The Opinions handed down on the 29th day of January, 2001 , are as follows:

BY KIMBALL, J. :

2000-KK- 0850 STATE OF LOUISINA v. SIDNEY COTTON (Parish of Washington) Molestation of a Juvenile and Oral Sexual Battery)

Accordingly, we cannot say that the trial court abused its discretion in refusing to admit the prior bad acts evidence. Because the State has failed to satisfy its burden of proof under LA. CODE EVID. art. 404(B), the ruling of the trial court is affirmed.

CALOGERO, C.J., concurs and assigns reasons.

VICTORY, J., dissents and assigns reasons.

TRAYLOR, J., dissents for reasons assigned by Justice Victory.

BY JOHNSON, J. :

2000-CA- 1176 EUGENE C. LATOUR, II, CLYDE LAFLEUR AND JOSEPH L. LACHNEY, JR. v . STATE OF LOUISIANA ; HONORABLE M.J. "MIKE " FOSTER, GOVERNOR; RICHARD P. IEYOUB, ATTORNEY GENERAL; WILLIAM R. "RUT" WHITTINGTON , SUPERINTENDENT STATE POLICE (Parish of Evangeline)

We conclude that the minimum age for purchasing lottery tickets and operating video poker is substantially related to the protection of the general welfare of this state. Accordingly, we overrule the district court's ruling that La. R.S. 47:9025(B)(2), 47:9070, and 27:319 are unconstitutional.

REVERSED

CALOGERO, C.J., additionally, concurs and assigns reasons.

LEMMON, J., dissents and assigns reasons.

KIMBALL, J., concurs and assigns reasons.

PER CURIAM :

1999-K- 2207 STATE OF LOUISIANA v. DWAIN MICHAEL JONES (Parish of Avoyelles)

Accordingly, the decision of the court of appeal is reversed and this case is remanded to the district court for execution of sentence.

JUDGMENT OF COURT OF APPEAL REVERSED; CASE REMANDED.

PATRICIA RIVET MURRAY, Associate Justice Ad Hoc, sitting for Knoll, J., recused.

JAMES C. GULOTTA, Justice Pro Tempore, sitting for Associate Justice, Harry T. Lemmon.

CALOGERO, C.J., dissents for the reasons assigned by Murray, J. ad hoc.

MURRAY, J., ad hoc, dissents and assigns reasons.

2000-KK- 1174 STATE OF LOUISIANA v. WENDELL PROFIT (Parish of Orleans) (Manslaughter)

Accordingly, the decisions below are reversed and this case is remanded to the trial court for further proceedings consistent with the views expressed herein.
