For these reasons,
the judgment of the court of appeal dismissing the action
is reversed. The case is remanded to the district court
for further proceedings consistent with this opinion.
Justice Harry
T. Lemmon, retired, participated in the decision in
this case which was argued prior to his retirement.

1246 STATE OF LOUISIANA v. NORMAN EDWARDS (Parish
of E. Baton Rouge)
Accordingly,
we find that the lower courts did not err in determining
Revised Stature 14:98(D)(2)(a) was constitutional. We
further find that Article I, Section 4 contemplates
both civil forfeiture and criminal forfeiture proceedings.
Thus, the assignment of error is without merit, and
Edwards' conviction and sentence are affirmed.

Disciplinary
Proceedings
Upon consideration
of the record, briefs and oral argument, it is ordered
that Ronald G. Hand be suspended from the practice of
law in the State of Louisiana for a period of eighteen
months, retroactive to the date of his September 12,
2000 interim suspension. Nine months of this suspension
shall be deferred, subject to a two-year period of probation.
All costs and expenses in the matter are assessed against
respondent in accordance with Supreme Court Rule XIX,
§10.1, with legal interest to commence thirty days
from the date of finality of this court's judgment until
paid.
