2002-KK- 0998 STATE OF LOUISIANA v. KELVIN WELLS (Parish of E. Baton Rouge)

WRIT APPLICATION(S) DENIED :

2000-KP- 2540 STATE OF LOUISIANA v. WESLEY GUILLARD AKA WESLEY WILLIAMS (Parish of Jefferson)

CALOGERO, C.J. & JOHNSON, J., concurs in the denial of writ and assign the following reasons:

The court of appeal opinion upsets the district courtâ€Ts sentence and remands the case for the imposition of a new sentence. After remand to the district court, Relator will be afforded the opportunity to appeal the conviction and newly imposed sentence and have both the conviction and sentence examined on appeal. That being the case, we agree to the denial of Relator's writ application without resolving whether or not the court of appeal has erred in upsetting the district court's ten-year sentence. For the foregoing reasons, we concur in the denial of the writ.

CALOGERO, C.J., assigns the following additional concurring reasons:

In addition, in my view, the ten-year sentence imposed by the District court was proper under the facts of the case, and a more onerous sentence, including the mandatory penalty under the Habitual Offender Law, would be excessive under the criteria set forth in State v. Dorthey , 623 So.2d 1276 (La. 1993).

2001-K - 1390 STATE OF LOUISIANA v. JAMES C. EVANS (Parish of Jefferson)

2001-KP- 1402 STATE OF LOUISIANA v. CLIFTON JONES, JR. (Parish of Avoyelles)

KNOLL, J., recused.
