The Opinion handed down on the 14th day of February, 2003, is as follows:


PER CURIAM:

Accordingly, the decision of the First Circuit is reversed, the trial court's ruling denying the motion to quash is reinstated, as are respondent's conviction and sentence, and this case is remanded to the district court for execution of sentence.
