The Opinions handed down on the 23rd day of May, 2003 , are as follows:

BY CALOGERO, C.J. :

 

2000-K- 3347       STATE OF LOUISIANA v. BYRON C. LOVE (Parish of Orleans)

                  (Possession of Cocaine With Intent to Distribute) The decision of the court of appeal vacating the defendant's conviction and sentence is reversed. The conviction and sentence are reinstated.

COURT OF APPEAL DECISION REVERSED; CONVICTION AND SENTENCE REINSTATED.

For the foregoing reasons, the decision of the court of appeal regarding the unconstitutionality of article LSA-R.S. 3:4278.2 and damages awarded to the minority co-owners is hereby reversed.

REVERSED.
