The Opinions handed down on the 9th day of September, 2003 , are as follows:

BY JOHNSON, J. :

 

2002-K -1895       STATE OF LOUISIANA v. DEREK TEMPLE (Parish of Orleans)

(Possession With Intent to Distribute Cocaine; Fourth Felony Offender)

For the reasons outlined above, we find that the contraband was seized without probable cause and should have been suppressed by the trial court. Accordingly, we affirm the decision of the court of appeal.

2002-C -1812       CIVIL SERVICE COMMISSION OF THE CITY OF NEW ORLEANS v. THE CITY OF NEW ORLEANS (Parish of Orleans)

2002-C -1815       The judgments of the lower courts with regard to the preliminary injunction are affirmed. However, the case is remanded to the trial court to establish a deadline for the city to submit the Agreement and its evidence to the Commission for review.

AFFIRMED IN PART AND REMANDED.
