FOR IMMEDIATE NEWS RELEASE

NEWS RELEASE # 069

FROM: CLERK OF SUPREME COURT OF LOUISIANA

On the 31st day of August, 2004, the following action was taken by the Supreme Court of Louisiana in the case(s) listed below:

REHEARING(S) DENIED:

2004-C -2182       CHARLES N. BRANTON v. BRYAN D. HAGGERTY,

VINCENT LOBELLO, AND MALISE PRIETO, CLERK OF COURT, PARISH OF ST. TAMMANY (Parish of St. Tammany)

CALOGERO, C.J., would grant a rehearing.
JOHNSON, J., would grant a rehearing.

On the 1st day of September, 2004, the following action was taken by the Supreme Court of Louisiana in the case(s) listed below:

INTERIM SUSPENSION DENIED; SEE ORDER:

2004-B -1142       IN RE: WALTER HUNTER, JR.

APPLICATION FOR ADMISSION TO BAR WITHDRAWN AT RELATOR'S REQUEST; SEE ORDER:

2004-OB-1717       IN RE: MARK A. MCADOO

REMAND TO DISCIPLINARY BOARD; SEE ORDER:

2004-B -1919       IN RE: BRIAN P. BRANCATO

On the 2nd day of September, 2004, the following action was taken by the Supreme Court of Louisiana in the case(s) listed below:

APPLICATION(S) NOT CONSIDERED:

2004-C -2239       FORUM FOR EQUALITY PAC, A REGISTERED LOUISIANA

POLITICAL ACTION COMMITTEE, LAURENCE E. BEST, JEANNE M. LEBLANC, AND WILLIAM A. SCHULTZ v. CITY OF NEW ORLEANS AND THE HONORABLE W. FOX MCKEITHEN, IN HIS OFFICIAL CAPACITY AS SECRETARY OF STATE OF LOUISIANA ONLY, AND NOT INDIVIDUALLY (Parish of Orleans)

WEIMER, J., concurs in the result. Miller v. Oubre, 96-2022 (La. 10/15/96), 682 So.2d 231 establishes a precedent that plaintiffs could arguably rely on in urging that their application was filed timely. We should not decide whether the result in Miller is correct without affording plaintiffs an opportunity to be heard. I concur in the result , however, because I believe the Court of Appeal was correct in finding the matter is premature.

WRIT APPLICATION(S) DENIED:

2004-C -2185       FORUM FOR EQUALITY PAC, A REGISTERED LOUISIANA

CALOGERO, C.J., concurs and assigns reasons.
