The Opinion handed down on the 16th day of June, 2006, is as follows:


BY CALOGERO, C.J.:

2005-K- 1382 STATE OF LOUISIANA v. HENRY LEE LEONARD
(Parish of E. Baton Rouge)(Second Degree Murder)
Accordingly, we reverse the court of appeal's ruling, which had upset the defendant's conviction for second degree murder, and remand the matter to the court of appeal for its determination as to whether the
guilty verdict actually rendered in this trial was surely unattributable to the error and, if necessary, for consideration of the assignment of error pretermitted in the court of appeal opinion.
REVERSED AND REMANDED.
