 2013 News Releases

News Release #006

FOR IMMEDIATE NEWS RELEASE
NEWS RELEASE #006

FROM: CLERK OF SUPREME COURT OF LOUISIANA

The Opinions handed down on the 29th day of January, 2013, are as follows:

BY KIMBALL, C.J.:

2012-CA-1471 LOUISIANA HIGH SCHOOL ATHLETICS ASSOCIATION, INC. v. STATE OF LOUISIANA, JAMES D. "BUDDY" CALDWELL, IN HIS OFFICIAL CAPACITY AS THE ATTORNEY GENERAL OF THE STATE OF LOUISIANA, LOUISIANA STATE BOARD OF ELEMENTARY & SECONDARY EDUCATION, & DARYL G. PURPERA, IN HIS OFFICIAL CAPACITY AS THE LOUISIANA LEGISLATIVE AUDITOR (Parish of E. Baton Rouge)

We find these statutes are unconstitutional under the Equal Protection Clause because they are arbitrary and capricious and they are not rationally related to a legitimate state interest. We therefore reverse the portion of the district court’s judgment denying the LHSAA’s Motion for Summary Judgment and conclude La. R.S. 24:513(A)(1)(b)(v) does not apply to the LHSAA and La. R.S. 24:513(J)(4)(a) and (b) are unconstitutional.
Affirmed in Part; Reversed in Part; Rendered.

VICTORY, J., dissents and assigns reasons.
WEIMER, J., concurs and assigns reasons.

BY JOHNSON, J.:

2012-C -1145 STATE OF LOUISIANA v. TONY J. GIBSON (Parish of St. Mary)
