WEIMER, J., would grant, but only as to the issue of whether the state abused its nolle prosequi authority when it dismissed the charges after the trial court denied the state's request for a continuance. See my dissent in State v. Love, 2000-3347 (La. 5/3/03), 847 So.2d 1198. As to all other issues, I would deny.
