PROPOSED LOUISIANA SUPREME COURT RULE AND FORMS REGARDING REPORTING OF ACTIONS FOR OFFENSES AND QUASI-OFFENSES
Act 706 of the 2010 Regular Session established a new system of having the Clerks of Court submit statistical information concerning offense and quasi-offenses “as required by Rule of the Supreme Court of Louisiana to the Office of the Judicial Administrator. . .” The law becomes effective on January 1, 2012. In that same Act, and also effective on January 1, 2012, the Legislature repealed La. R.S. 9:2800.7, which now requires the reporting of similar information by the Clerks of Court to the Commissioner of Insurance
In accordance with 2010 La. Acts 706, the Louisiana Supreme Court is considering adopting (i) Part G, Section 13 to the Rules of the Louisiana Supreme Court (“Reporting on Actions for Offenses and Quasi-Offenses”), (ii) a one-page Civil Case Reporting Form, and (iii) a one-page Civil Case Judgment Reporting Form. As envisioned by the draft Court rule and forms, counsel for the petitioner, the petitioner’s representative, or the pro se litigant would complete the Civil Case Reporting Form at the commencement of litigation. The Civil Case Judgment Reporting Form would be completed by the Clerk of Court when civil judgments are rendered, or claims are dismissed. Both forms will be forwarded to the Office of the Judicial Administrator by the Clerk of Court on a monthly basis.
