RESOLUTION
____________
WHEREAS, on June 17, 1998, the Court
promulgated amendments to Louisiana Supreme Court Rule XX, entitled "Limited
Participation of Law Students in Trial Work" (hereinafter referred to as the
"Student Practice Rule"); and
WHEREAS, in consideration of a request
for reconsideration and a stay filed by two law schools, the Court on June 30,
1998, amended Section 5 of the Student Practice Rule and suspended implementation
of Section 10; and
WHEREAS, the Court then asked the law
schools to file briefs concerning the suspended section of the rule; and
WHEREAS, the law school briefs were forwarded
to four organizations for response; and
WHEREAS, the Court subsequently reviewed
the original and responsive briefs, and also considered additional changes to
the Student Practice Rule; and
WHEREAS, after this review, the Court
decided the promulgation of additional amendments to the Student Practice Rule
will effect advisable changes.
NOW, THEREFORE, BE IT RESOLVED, that
the Court hereby amends and reenacts Rule XX of the Rules of the Supreme Court
of Louisiana. The amendments have been promulgated pursuant to Article V, Sections
1 and 5 of the 1974 Louisiana Constitution, and the inherent power of this Court.
The amendments shall become effective on April 15, 1999. The amendments shall
not impact or apply to any cases, and/or the representation of any clients,
in which the representation commenced prior to the effective date of the amendments.
