<p><strong>Public Statement from the Louisiana Supreme Court on the death of retired Justice Harry T. Lemmon</strong></p><p>On behalf of the Louisiana Supreme Court Justices, Chief Justice John L. Weimer issued the following statement today:</p><p>“The Justices of the Louisiana Supreme Court and I mourn the passing of retired Louisiana Supreme Court Justice Harry T. Lemmon. Justice Lemmon served as an Associate Justice on the state Supreme Court from 1980-2001 and as a Judge on the Louisiana Fourth Circuit Court of Appeal from 1970-1980. We express our profound sadness and heartfelt condolences to the family of Justice Lemmon, including his wife of 64 years, Judge Mary Ann Vial Lemmon, as well as their six children and thirteen grandchildren. Justice Lemmon dedicated his life to serving the Louisiana judiciary and his country. He will be remembered as a pillar in the legal field and will be greatly missed.”</p><p>Upon the passing of retired Justice Lemmon, the Justices of the Louisiana Supreme Court issued a Resolution recognizing Justice Lemmon’s life and legacy; a copy of the Resolution was presented to the family of Justice Lemmon at his memorial service.</p><p>Justice Lemmon was born in Morgan City, Louisiana, on December 11, 1930, and graduated from the Southwestern Louisiana Institute (now the University of Louisiana-Lafayette), receiving the Alumni Award. After working as a chemist for four years and serving two years in the United States Army, he earned his law degree from Loyola University School of Law in New Orleans, graduating <em>cum laude</em>. He began his legal career at the firm of Vial, Vial, and Lemmon in Hahnville and was elected to the Court of Appeal, Fourth Circuit, in 1970. He became a Justice of the Supreme Court on May 16, 1980, and served until his retirement on May 16, 2001.</p><p>Justice Lemmon was committed to the furtherance of the integrity of the law profession, in addition to his judicial work, Justice Lemmon taught law at Loyola University, Louisiana State University, and Tulane University, all pro bono. He chaired the Ainsworth Lecture Committee, ensuring high standards in legal education, and lectured across the U.S. and internationally. Justice Lemmon co-authored the "Louisiana Civil Law Treatise on Civil Procedure" and served on various committees for the Louisiana State Law Institute. He led the Louisiana Judicial College for over 20 years, providing continuing legal education for judges. He held several national roles, including Chair of the American Bar Association Committee on Continuing Education for Appellate Judges.</p><p>He received an honorary Doctor of Laws from Loyola Law School, the St. Ives Award in 2002, the Louisiana Bar Foundation’s Distinguished Jurist Award, and was inducted into the LSU Law Center Hall of Fame. </p>

Among other things, in order to qualify to take this truncated bar exam, an attorney would have to have been engaged in the active practice of law for five out of the last seven years immediately preceding the date of application and would need to be a resident of the State of Louisiana prior to admission to the Bar. Proposed Rule 1.5(f)(2) would continue to allow attorneys to place in their operating accounts all or part of a fixed or minimum fee but would require that the lawyer advise the client in writing that such funds will be placed in the attorney’s operating account and not in the lawyer’s trust account. <p>Please note that after review of the Judges’ Supplemental Compensation Fund computation formula and in accordance with the provisions of La. R.S. 13:10.3, the fee to file a writ application with the Louisiana Supreme Court will increase from $328.00 to $330.00, effective July 1, 2023.</p>

<p><strong><span style="text-decoration:underline;">Louisiana Supreme Court Amends Rule of Professional Conduct 1.15(d)</span>:</strong> <br />The Louisiana Supreme Court recently amended Louisiana Rule of Professional Conduct 1.15(d) to clarify a lawyer’s duty with respect to the interests of third parties in funds or other property in the lawyer’s possession. <a href="/rules/orders/2022/ROPC_RULE1.15§(d).pdf" target="_blank">This rule change</a> has an effective date of December 1, 2022. </p>

<p><strong><span style="text-decoration:underline;">Louisiana District Court Rules – Latest Rule Amendments Now Online (New Rule 31.4 and Appendices 31.4A and 31.4B)</span></strong><br /></p><p style="margin-left:30px;">In response to the Legislature’s recent passage of Act 277 (<a href="http://legis.la.gov/legis/ViewDocument.aspx?d=1144038" target="_blank">link</a>), which amended the La. R.S. 46:236.2 procedure for redirection of child support payments by the Department of Children and Family Services (DCFS) in Title IV-D matters, the Court Rules Committee proposed addition of a new District Court Rule 31.4, with accompanying Appendices 31.4A and 31.4B, to Title IV of the District Court Rules. These proposed amendments were posted on the Supreme Court’s website for a 30-day public comment period that ran through July 21, 2019. Once the comment period ended, the Court Rules Committee reviewed all comments received and made any changes it deemed appropriate. Thereafter, the proposed amendments were submitted to the Supreme Court for review, and the Court approved the amendments on September 19, 2019. <p>The procedure for applying for Judicial Council recommendation regarding a new or increased court cost has changed. As per Act 553 of 2018, the application deadline for a new or increased cost has been changed to October 15 of the year prior to the calendar year the proposal is intended to introduced in the legislature.</p><p>The application and guidelines are currently under revision to reflect the legislative changes. The final application and guidelines will be posted after Judicial Council approval. <p style="margin-bottom:0px;"><span style="text-decoration:underline;"><strong>Updated Louisiana District Court Rules Now Online</strong></span> </p><div align="center"></div><p>Following a 30-day public comment period and Committee review of all comments received, the Louisiana Supreme Court approved the <a href="http://www.lasc.org/rules/dist.ct/Spring_2017_District_Court_Rule_Amendments_with_Signed_Order.pdf"><strong>latest District Court Rules amendments</strong></a> on May 16, 2017.
